Panora Tours and Safaris offer Kenya Tour packages and other services including: tour logistics, hotel bookings, flight ticketing, honeymoons, car hire, family travel and others. The activities we offer include : hiking, bird watching, nature trails, road trips,city tours,excursions, mountain climbing safaris, cultural Africa safari. These terms and conditions apply to all tours/safaris/trips and excursions offered by Panora Tours and Safaris Ltd. Hereby also referred to as The Company/Safari Company to clients/guests / passengers/Tourists.

TRAVEL DOCUMENTS

It is of utmost importance that you thoroughly check your visa requirements before your intended date of travel. Panora Tours and Safaris Ltd will not be held responsible should the necessary visa requirements not be fulfilled. Client should have necessary valid travel documents like passport, visas, vaccination certificates and other flight requirement as needed by airline.We won’t be liable to refund fare or compensation if client is refused entry into a country for any reason.

BOOKING AND PAYMENT

All reservations can be made by email, phone or coming to our offices. Bookings are only confirmed after a 50% deposit of the total amount has been paid. The balance should be paid to not later than 45 days before the start of the tour/safari. Payment should be made in full for all bookings made in less than 45 days before the tour.The payment is NET of all bank charges, both on sending and receiving. All payments should be made either by cheques, Lipa na M-Pesa, Visa. Master Card via Telegraphic Transfer to Panora Tours and Safaris Ltd bank account to be provided. Credit card payments will attract a 5% bank surcharge. If a cheque issued by client is returned by bank for any reason the client shall replace it within seventy two (72) hours with certified funds. Returned Cheque will be charged USD 50.00. Credit card payment details will be sent to clients through a link to enable online payment.

CANCELLATION POLICY

Cancellation or reduction in the number of days must be notified in writing. It will take effect the day it is received by Panora Tours and Safaris Ltd. Cancellation fees will be due and payable as below:1. Between 61 & 75 days, 15% of the total cost will be charged2. Between 45 & 60 days, 25% of the total cost will be charged3. Between 31 & 45 days, 50% of the total cost will be charged4. Between 30 days & a ‘No Show’ 100% of the total cost will be charged.No refund is available for cancellations after commencement of tour arrangements or on any services not used.

TRAVEL ARRANGEMENTS.

Travel arrangements like flight,hotel and transport reservation made by the company are subject to booking and cancellation provisions of supplier. We reserve the right to amend our rates in the event of changes in direct costs to us.

INSURANCE

Client should have Comprehensive travel and medical insurance covering his/her personal requirements. The insurance should cover following but not limited to: cancellation of safari and services booked, emergency evacuation, medical, repatriation, damage/theft/loss of personal baggage, money and goods. The Company including their representatives, will take no responsibility for any costs or losses incurred by the guests their dependents or traveling companions, with regards to, but not limited to, any of the above mentioned eventualities. Guests will be charged directly by the relevant service providers for any emergency services they may require. Please note that credit card travel insurance is inadequate for tours in Kenya. The choice of insurer is the sole discretion of the client.The client acknowledges that services arranged by the company, whether in civilized or remote areas by plane, vehicle, train, boat, horseback, foot or other conveyance contains inherent risks of injury. Illness, death, or loss and damage to property, which may be caused by forces of nature, accidents, wild animals, negligence of others, and other causes known or unknown. The tourist acknowledges that such risks may be present at any time before, during or after the tour and that medical service and facilities may not be readily available during the tour. The customer expressly assumes any and all risks with respect to the activities and circumstances described herein and the company will not liable on account of any losses, claims, costs, liabilities or damages.

HEALTH

Client acknowledges being aware of proposed itinerary ensure that he/she is medically fit and able to participate in the tour. If sickness or accident interrupts a Kenyan tours, the company shall not be liable for any cost arising there from. Except if such sickness or accident was caused by the operator’s willful act or gross negligence. The Company shall not be liable for any refund, either in total or partial.Please advice us well in advance, should you have any special dietary requirements.

INDEMNITY

Panora Tours and Safaris Ltd acts as an agent in packaging tours in Kenya and other travel arrangements utilizing the products of various travel suppliers. The company makes every effort  to engage quality suppliers among the airlines, hotels and other service providers  to ensure that the various services making up the different tours will be carried out efficiently and as specified it does not have direct control over the provision of services of  the operator, the supplier, the operator’s or supplier’s servants and shall not be liable for any loss, damage, injury, additional cost, delay, irregularity that may be occasioned by any error or default, act or omission of any supplier in carrying out the arrangement of any tour or otherwise in connection therewith, except in the case of willful negligence or a willful act or omission.Should the company appoint a tour leader or guide in respect of any tour, then the client must accept all reasonable instructions of such tour leader or guide.Panora Tours and Safaris Ltd shall in no circumstances be deemed to be the agent of the passenger or of the supplier of any service.Panora Tours and Safaris Ltd believe that the contents of this website are correct at the time of publishing, but all prices and services are subject to change or withdrawal without notice. The Safari Company will not be responsible for loss or damage arising from any errors or omissions contained in its website, literature or information sources.

PASSENGER RESPONSIBILITY

 Passengers must not carry any unlawful articles or substances while traveling. If any passenger offends against the prohibitions set out herein, the operator will be entitled to immediately exclude from the tour the offender who will be responsible for his or her own repatriation and all costs thereof. The operator will under no circumstances assist any such offender in any dealings or negotiations with any authority. Jurisdiction In all matters where it is or may be necessary to have recourse to the Court, the Courts of the Republic of Kenya shall have sole jurisdiction to the exclusion of the Courts of any other country and the prevailing law of the Republic of Kenya shall prevail concerning all tours.Travellers shall be solely responsible for complying with the formalities required by police, customs, health and all other authorities at the point of departure, at the destination and whilst in transit.The Company may at its discretion and without liability or cost to itself at any time decline, cancel or terminate the guest’s booking in the event of illness, illegality, non-payment of any amount due by the client, or if client interferes with any other member of any group and/or causes any disturbance or nuisance, the client shall in such circumstances not be entitled to any refund. The client undertakes and agrees that he/she will, at all times, comply to a reasonable code of conduct during the safari and will not in any way constitute a nuisance to the other persons on tour

PRICE INCREASE

The Safari Company reserves the right to increase their tour fares due to any increase in airline flight tariffs, fuel costs, game reserve entry fees, fluctuation of exchange rates, government actions and other factors beyond the companies control. The company will use its best endeavors to provide all tours as confirmed, reasonable changes in the itinerary may be made without notice if necessary.

RESERVE ENTRY & CONCESSION FEES

Reserve Entry & Concession fees in any tours are payable at the time of reservation and are subject to change upon short notice as they are controlled by the Kenya Wildlife Service or other facility officers. Any changes will be passed on in full even for pre-paid clients. In most cases the reserve, park and concession fees will be included in the total cost, unless indicated otherwise.

ALTERATION OF ROUTES AND SUBSTITUTION OF ACCOMMODATION

The company reserves the right to alter or substitute routes,meals, accommodation, itineraries, tours, services, flight changes,vehicles and arrangements in case of conditions beyond our control. Such cases like/ but not limited to road conditions, weather, mechanical breakdown, accident, border closure, local politics or a multitude of other factors. In case of alterations, the leader will decide on the best alternative based on the best interests of the clients. We will do everything possible to minimize the effect, but we can’t be responsible for the results of changes or delays. The Company takes every care to ensure that itineraries are followed to the letter but unforeseen circumstances may necessitate changes. We accepts no liability due to the alteration of routes or substitution of properties. Where properties or services are substituted, we will offer substitutes of equal value and standard and inform the client of any known changes before departure.The Company shall have the right at any time at its discretion to cancel any safari and services or the remainder thereof or make alterations in route, accommodation, price or other details and, in the event of any safari and services being rendered impossible, illegal or inadvisable by weather, strike, war, government or interference or any other cause whatsoever, the extra expenses incurred including but not limited to the cost of flying back home, alternative accommodation, food, personal expenses and all resulting costs are to be borne by the client

FLIGHT AND TRANSFERS

For internal flight within Kenya guests are advised to pack in soft bags with a maximum of 15kg per person in their tours. Transfers to additional destinations can be arranged and vary in price and duration depending on the length of the journey and the condition of the access roads.

INTERNATIONAL AND DOMESTIC FLIGHT BOOKINGS

Reconfirmation of flight bookings is the responsibility of the traveller. As tour arrangements may be booked to connect with international and domestic air flight it is your responsibility to keep us updated as to your flight times and numbers.

DISPUTES

Any claim or dispute which may arise between client and the company including any claim for loss or damage due to injury to person or property or any other, must be brought to the attention of Panora Tours and Safaris Ltd prior to the client’s departure in order to finalize the issues on the ground at the time. Where this is not possible then they are to be followed up in writing no later than 14 days after the tours where the Kenya legal system will be adhered to exclusively.By attending our Kenya tours ,we need your consent to be photographed,filmed and/or recorded as a member of the entourage. Any/all use and distribution of all photographs/videos and any other recorded materials can be used without any form of payment to you. In use of such materials, Panora Tours and Safaris shall not be liable for any injury,damages or loss that may arise.PAYMENT OF A DEPOSIT WILL INDICATE AN ACCEPTANCE OF THESE BOOKING CONDITIONS BY THE PASSENGER/CLIENT.
